Terms of Service

Please read these Terms of Service carefully before using DavinaRadius. By creating an account or using the platform in any way, you agree to be bound by these terms. If you do not agree, do not use the platform.
1. The Service
DavinaRadius is an ISP management platform that provides RADIUS authentication, PPPoE billing, captive portal management, router configuration, payment processing integrations, and related tools for internet service providers. We may update, expand, or remove features of the platform at any time. When significant changes affect your workflow, we will aim to give you advance notice.
2. Account Registration
To use DavinaRadius, you must register for an account. You agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at [email protected].
3. Acceptable Use
You may use DavinaRadius only for lawful purposes and in accordance with these terms. You must not:
- Use the platform for any activity that violates applicable laws or regulations
- Attempt to gain unauthorised access to any system, account, or data on the platform
- Interfere with the performance or availability of the platform for yourself or others
- Use the platform to distribute malware, spam, or any harmful content
- Resell or sublicense access to the platform without our prior written permission
- Attempt to reverse-engineer, decompile, or extract the source code of the platform
We reserve the right to investigate suspected violations and to take appropriate action, including suspending or terminating accounts.
4. Your Network and Customer Data
You retain full ownership of all data you upload or generate through the platform, including your customer records, network configurations, and transaction history. By using DavinaRadius, you grant us a limited, non-exclusive license to store and process that data solely to deliver the service to you.
You are solely responsible for ensuring that your collection, storage, and use of your own customers' personal data complies with all applicable privacy and data protection laws. We are not a data controller with respect to your customers and we will act only as your data processor under your instructions.
5. Payment and Billing
DavinaRadius subscription fees are based on your monthly sales volume, as published on the pricing page. Fees are billed monthly. If a payment fails, we may restrict access to the platform until the outstanding balance is settled.
All fees are non-refundable except where required by applicable law. We will provide reasonable notice before changing subscription pricing, giving you the opportunity to close your account before the new rates apply.
6. Service Availability
We aim to keep DavinaRadius available around the clock, but we do not guarantee uninterrupted access. Scheduled maintenance, software updates, infrastructure issues, or events outside our control may temporarily affect the platform. We will make reasonable efforts to notify you of planned maintenance in advance and to restore service as quickly as possible after any outage.
7. Intellectual Property
DavinaRadius, including all software, content, design, and trademarks, is owned by DavinaRadius and protected by applicable intellectual property laws. Nothing in these terms transfers any ownership rights to you. Your right to use the platform is limited to the license granted while your account is in good standing.
8. Disclaimers
DavinaRadius is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, fitness for a particular purpose, or uninterrupted operation of the platform. We are not responsible for decisions you make based on data, reports, or alerts generated by the platform.
9. Limitation of Liability
To the maximum extent permitted by law, DavinaRadius and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, even if we have been advised of the possibility of such damages.
In any case, our total liability to you for any claim arising under these terms will not exceed the total fees you paid to DavinaRadius in the one calendar month immediately preceding the event giving rise to the claim.
10. Termination
You may close your account at any time by contacting us at [email protected]. We may suspend or terminate your account if you violate these terms, fail to pay subscription fees after reasonable notice, or if we are required to do so by law. We may also terminate your account for any other reason by giving you thirty days written notice by email.
Upon termination, your access to the platform will end. We will handle your data as described in our Privacy Policy.
11. Governing Law
These terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or relating to these terms or your use of DavinaRadius will be subject to the exclusive jurisdiction of the courts of Kenya.
12. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of any material changes by email or through a notice on the platform. If you continue to use DavinaRadius after updated terms take effect, you accept those changes.
